1. Introduction and acceptance of terms

These Terms & Conditions ("Terms") govern your use of the GutsyGal website, content, programs, and services (together, the "Services"). GutsyGal is a health-and-wellness education and health coaching business founded by Jenny Bishop, an Integrative Nutrition Health Coach credentialed by the Institute for Integrative Nutrition.

By accessing the website, purchasing a program, or working with GutsyGal in any way, you agree to these Terms. If you do not agree, please do not use the Services. You must be at least 18 years old to use the Services.

2. Educational purpose and no medical advice

GutsyGal offers online health-and-wellness education and one-on-one health coaching for perimenopausal and menopausal women, including women taking GLP-1 medications such as Ozempic, Wegovy, Mounjaro, and Zepbound, with gut and microbiome health as the through-line. Our method is called Prescriptive Microbiome Wellness. The paid one-on-one program is The Gutsy Reset.

Because the Services are educational, please understand that:

• Decisions about medications, dosing, and hormone therapy belong with your own qualified clinician. GutsyGal does not start, stop, adjust, or advise on any prescription.
• Any physician-ordered lab testing referenced in connection with the Services is arranged through a licensed physician partner (for example, through Rupa Health and a signing physician). GutsyGal itself does not order labs and does not practice medicine.
• Individual results vary, and no specific outcome is promised or guaranteed.
• You should consult your clinician before changing your diet, taking any supplement, or acting on any information from the Services, especially if you are pregnant, nursing, taking medication, or living with a health condition.

3. Health coaching scope and your responsibilities

Health coaching supports education, goal setting, accountability, and lifestyle habits. It is an unlicensed service. Your coach does not act as a physician, nurse, pharmacist, dietitian, psychologist, or any other licensed healthcare professional, and does not provide services that require a license.

When you work with GutsyGal, you agree that you are responsible for:

• Working with your own physician or prescriber for diagnosis, treatment, medication, and monitoring.
• Sharing accurate information about your health so that education can be relevant to you.
• Using your own judgment and consulting your clinician before acting on any educational information.
• Seeking prompt medical attention for any symptom that concerns you.

4. No doctor-patient or licensed-professional relationship

Using the Services does not create a doctor-patient relationship, a therapist-client relationship, or any other licensed-professional relationship between you and GutsyGal or Jenny Bishop. Jenny Bishop is an Integrative Nutrition Health Coach; she is not your physician, prescriber, or other licensed provider, and coaching is not a substitute for care from those professionals. If a licensed physician partner orders lab testing, that clinical relationship is between you and that physician, not GutsyGal.

5. Programs, purchases, and payments

Paid programs, including The Gutsy Reset, and any sessions or products offered through the Services are described at the point of purchase, including their price and what is included. Payments are processed by Stripe. By purchasing, you agree to Stripe's terms and to provide accurate billing information. GutsyGal does not store your full payment card details.

Refunds. Payments for coaching programs and sessions are non-refundable once the program or session has begun. If something exceptional happens, contact us at hello@gutsygal.com and we will consider refund requests on a case-by-case basis. Where a refund is granted, it will be issued to the original payment method.

Some purchases made through third-party services (for example, microbiome testing kits or supplements) may be subject to that provider's own pricing, billing, and refund terms in addition to these Terms.

6. Third-party services and links

The Services rely on and may link to third-party tools and providers. These may include, among others:

• GoHighLevel and HEYbirdie, for the website, funnels, forms, and email automation.
• Tiny Health, for microbiome testing kits.
• Fullscript, for the supplement dispensary.
• Practice Better, for the client portal.
• Stripe, for payment processing.
• Rupa Health and a signing licensed physician, for any physician-ordered lab testing.

Each third-party provider is independent of GutsyGal and has its own terms and privacy practices, which govern your use of that provider. GutsyGal does not control and is not responsible for third-party services, their products, or the content of any linked site, and any dealings you have with them are between you and that provider.

7. Intellectual property and trademarks

All content in the Services, including text, graphics, curricula, program materials, and design, is owned by GutsyGal or its licensors and is protected by copyright and other laws. You may use it for your own personal, non-commercial reference. You may not copy, republish, resell, or distribute it without written permission.

GutsyGal, Prescriptive Microbiome Wellness, Self-Care Rx, The Gutsy Reset, and Breakthrough Session are trademarks used by the brand. Third-party names and marks, including the providers listed above and medication brand names such as Ozempic, Wegovy, Mounjaro, and Zepbound, are the property of their respective owners and are used only for identification.

8. User conduct

When using the Services, you agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Copy, resell, or redistribute program materials without permission.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services or their systems.
• Impersonate any person or misrepresent your affiliation with anyone.
• Upload or transmit anything unlawful, harmful, or infringing.

9. Disclaimers of warranties and limitation of liability

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. GutsyGal does not warrant that the Services will be uninterrupted, error-free, or that any educational information will produce a particular result.

To the fullest extent permitted by law, GutsyGal and Jenny Bishop will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of, or reliance on, the Services. To the fullest extent permitted by law, the total liability of GutsyGal and Jenny Bishop for any claim relating to the Services will not exceed the amount you paid for the specific program or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless GutsyGal and Jenny Bishop from and against any claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing law and dispute resolution

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules. GutsyGal operates from Kansas. Please note that clients located in other states, including telehealth or lab clients, may be subject to their own state's rules, and nothing in these Terms is intended to waive any consumer protection you cannot lawfully waive.

If a dispute arises, you and GutsyGal agree to first try in good faith to resolve it informally by contacting each other and allowing thirty (30) days for resolution before filing any claim. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in the State of Kansas, and you consent to the jurisdiction of those courts.

12. Changes to these terms

GutsyGal may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Services after changes are posted means you accept the updated Terms. Please review this page periodically.
